Terms of Use

1. Purpose

These Terms of Use (“Terms”) define the conditions under which Vopenia (“Vopenia”, “we”), publisher of the OpenVisio service (website and iOS/Android mobile apps, the “Service”), makes the Service available to users (“you”, the “User”), and the parties’ rights and obligations. OpenVisio is a video-conferencing solution to create and join video meetings, exchange real-time audio and video, share a meeting link, manage participants and receive call notifications.

2. Acceptance

Accessing or using the Service implies full acceptance of these Terms. By creating an account or using the Service, the User acknowledges having read and accepted them. If the User does not accept the Terms, they must refrain from using the Service.

3. Description of the Service

The Service enables real-time video-conferencing meetings. Audio and video streams are transmitted via WebRTC and are not recorded by default. Some features may depend on the plan or device. Vopenia may modify, add or remove features at any time to improve the Service.

4. Access and user account

4.1 Account creation

Certain features require an OpenVisio account. For the public sector, sign-in may be performed via ProConnect (French State identity). The User undertakes to provide accurate information and keep it up to date.

4.2 Credentials and security

The User is responsible for keeping their credentials confidential and for all activity from their account, and must notify Vopenia without delay of any unauthorised use at contact@vopenia.io.

4.3 Technical requirements

Access requires compatible equipment, an up-to-date browser or the mobile app, and an Internet connection at the User’s expense.

5. Acceptable use

The User undertakes to use the Service lawfully and fairly, and in particular not to:

  • distribute unlawful, defamatory, hateful, violent, pornographic, infringing content, or content harming third-party rights;
  • record, capture or broadcast a meeting or a participant’s image/voice without their information and, where required, consent;
  • undermine the security or integrity of the Service (intrusion, injection, circumvention, overload, reverse engineering);
  • use the Service for harassment, impersonation, spam or unauthorised data collection;
  • disrupt other users’ meetings.

In the event of breach, Vopenia may suspend or terminate access, without prejudice to any other action.

6. Liability for user content

The User is solely responsible for the content they transmit or share via the Service (audio, video, messages, files). Vopenia acts as a technical host within the meaning of the LCEN and does not exercise prior control over such content. Vopenia may remove any manifestly unlawful content reported to it, under the conditions of the LCEN.

7. Intellectual property

The Service, its software components, trademarks, logos, interfaces and databases are protected by intellectual property law and remain the exclusive property of Vopenia or its partners. These Terms grant the User a personal, non-exclusive and non-transferable right to use the Service. The User retains all rights to their own content.

8. Availability and maintenance

Vopenia endeavours to keep the Service available 24/7, without obligation of result. The Service may be interrupted for maintenance, updates, security or force majeure. Vopenia endeavours to inform users of scheduled interruptions.

9. Limitation of liability

The Service is provided “as is”. To the extent permitted by law, Vopenia shall not be liable for indirect damages (loss of business, data, revenue), for interruptions or degraded quality attributable to the network, the User’s equipment or third parties, or for the User’s use of the Service or the content exchanged. Nothing in these Terms limits Vopenia’s liability in cases of gross negligence, wilful misconduct, bodily harm, or where the law prohibits it.

10. Personal data

The processing of personal data is described in the Privacy Policy and the Cookie Policy.

11. Term, suspension and termination

These Terms apply throughout the use of the Service. The User may stop using the Service and delete their account at any time. Vopenia may suspend or terminate access in the event of breach, security risk or legal obligation, where appropriate after informing the User.

12. Amendments

Vopenia may amend these Terms at any time. The applicable version is the one in force at the time of use, published at the Service address with the date of update. Continued use following a substantial change constitutes acceptance.

13. Governing law and jurisdiction

These Terms are governed by French law. Failing amicable resolution, any dispute falls under the jurisdiction of the French courts, subject to mandatory consumer-protection rules. Under Articles L.611-1 et seq. of the French Consumer Code, a consumer may resort free of charge to a consumer mediator, where applicable.
